о возбуждении уголовного дела и принятии его к производству

в отношении неустановленного лица, -
УСТАНОВИЛ:
В неустановленное время, но не позднее. 27.12.2020 года, неустановленное лицо,
находясь в неустановленном месте, используя неустановленные технические средства,
распространило в социальной сети «Facebook» на странице с именем «[скрыто]
Арцинович» публично демонстрирующуюся статью, содержащую заведомо ложные
сведения, порочащие честь и достоинство, а также подрывающие репутацию гр.
[скрыто] [скрыто], который впервые обнаружил 27.12.2020 в неустановленном точно
дознанием месте, в связи с чем гр. [скрыто] [скрыто] обратился в ОМВД России по району
Хамовники г. Москвы по адресу г. Москва, [скрыто][скрыто]
Принимая во внимание, что имеются достаточные данные, указывающие
на признаки преступления, предусмотренного ч. 2 ст. 128.1 УК РФ, руководствуясь ст.
140, 146 (147) и частью первой ст. 156 УПК РФ.
ПОСТАНОВИЛ:
Возбудить уголовное дело в отношении неустановленного лица по признакам
состава преступления, предусмотренного ч. 2 ст. 128.1 УК РФ.

Уголовное дело принять к своему производству и приступить к его
расследованию.

DECISION to open a criminal case and to take it up for investigation

The Head of the Inquiry Unit of the Internal Affairs Department of Russia for the Khamovniki District of Moscow, police major [скрыто] [скрыто] [скрыто], having examined inquiry material [скрыто] of 24 August 2021 in respect of an unidentified person, —

At an unidentified time, but no later than 27.12.2020, an unidentified person, being in an unidentified place and using unidentified technical means, disseminated on the "Facebook" social network, on the page under the name "[скрыто] Artsinovich", a publicly displayed article containing knowingly false information which defames the honour and dignity and also undermines the reputation of citizen Yu. [скрыто] [скрыто], who first discovered it on 27.12.2020 in a place not precisely established by the inquiry, in connection with which citizen Yu. [скрыто] [скрыто] applied to the Internal Affairs Department of Russia for the Khamovniki District of Moscow at the address: Moscow, [скрыто].

Taking into account that there are sufficient data indicating the elements of an offence under Article 128.1(2) of the Criminal Code of the Russian Federation, guided by Articles 140, 146 (147) and Article 156(1) of the Criminal Procedure Code of the Russian Federation,

1. To open a criminal case in respect of an unidentified person on the basis of the elements of the offence under Article 128.1(2) of the Criminal Code of the Russian Federation.
2. To take the criminal case up for his own investigation and to commence the investigation.
3. To send a copy of this decision to the Khamovniki Inter-District Prosecutor of Moscow.
4. To notify the interested persons of the decision taken.
